This privacy policy (“Privacy Policy”) for Clubfeast Inc (collectively, “Feast,” “we,” “us” or “our”) describes how we collect, use, and disclose information about users of the Company’s website [https://www.clubfeast.com] (the “Website”), applications, services, tools and features (collectively, the “Services”). For the purposes of this Privacy Policy, “you” and “your” means you as the user of the Services.

BY USING OR ACCESSING ANY OF THE SERVICES, YOU AGREE TO THE USE OF YOUR INFORMATION DESCRIBED IN THIS PRIVACY POLICY AND TO THE OTHER TERMS OF THIS PRIVACY POLICY. THE SERVICES ARE FOR INDIVIDUALS IN THE UNITED STATES ONLY AND ARE NOT INTENDED FOR USERS LOCATED OUTSIDE THE UNITED STATES.   1. UPDATING THIS PRIVACY POLICY

    We may update this policy from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Policy, post the updated version to the Website, and/or otherwise provide notice through the Services and take any other steps to comply with applicable law. We encourage you to review this Privacy Policy periodically to stay informed about our information practices.

  2. Categories of Personal Information We Collect

    We may collect the following information through your use of the Services, that may individually or together with other information identify you (“Personal Information”):

    1. Information commonly ud to identify you, such as your name, physical address, email address, phone numbers and other similar identifiers.

    2. Information about your Feast subscription, purchases or receipt of meals we have delivered to you, ingredients in your delivered meals, and the use of our Services, which includes:

      1. Delivery and dietary preferences;

      2. Information related to returns, refunds and cancellations;

      3. Information about gift orders and referrals;

      4. Information about your interactions with technical and/or customer support; and

      5. Information about your orders, order reviews, and feedback.

    3. Payment information, such as debit and credit card information. When you pay to use the Services, your payment card information goes directly to a payment processing company. Refer to Section 5 for more information.

    4. Basic account information related to your Facebook, Apple, or other third-party account if you choose to register and sign in using such an account. This information includes your username and information whether you entered your password correctly. These services are designed so that Feast doesn’t see your actual password for these services – just whether you got the password right or wrong

    5. Information you provide to us when you apply to add your business to our platform. This information includes Restaurant name and address, email address and phone number.

    6. Other information you upload or provide while using the Services, such as when you request technical or customer support, refer other individuals to Feast or share Feast gift certificates.

    7. Usage Data, as described further below.

    We also collect information automatically when you interact with the Services (“Usage Data”). To do this, Feast and the vendors we work with – including web analytics vendors and companies that help us market the Services – use various tracking technologies, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve the Websites and your experience, see which areas and features of the Websites are popular, and count visits. Web beacons are electronic images that may be used on the Websites or in emails and help deliver cookies, count visits and understand usage and campaign effectiveness. Usage Data we collect includes:

    1. Internet protocol (IP) addresses;

    2. Browser type;

    3. Internet service provider (ISP);

    4. Referring/exit pages;

    5. Files viewed on our Website (e.g., HTML pages, graphics, etc.);

    6. Operating system and version;

    7. Date/time stamp and clickstream data;

    8. MAC address or other device ID (UDID);

    9. Device type; and

    10. With your consent, information about the location of your device as well as information from certain native applications on your device, such as your device’s camera, photo album and phonebook applications.

    You can adjust certain settings, such as by turning off cookies in your browser or adjusting privacy settings in our apps, to reduce the amount of information we passively collect from you when you use the Services. Because we use these features to enhance your user experience (such as using cookies to remember your email address when you visit the Services), disabling such features may impact the Services’ functionality.

    Your browser settings may also allow you to transmit a “Do Not Track” signal when you visit various websites.   3. How we collect Personal Information

    We collect many of the categories of information listed above when you affirmatively give it to us or use the Services. You may always choose not to provide that Personal Information to us but note that you may be unable to access certain services or features if they require Personal Information that you have not provided.   4. Why we collect Personal Information

    We collect and use the categories of information listed above in order to get you delicious meals and otherwise provide the Services, to communicate with you about your subscription and the Services, to provide customer support and troubleshooting, to improve our business (including the Services), to deliver targeted ads, for security purposes, for other legitimate business purposes, or as required by law.

  5. Our disclosure of Personal Information

    We may share information with our service providers. These are other companies that help us run our business, and who have promised only to use Personal Information subject to this Privacy Policy in order to help Feast run its business. For example, at present, Feast uses Stripe and to process payments. Information collected directly by Stripe, including your full payment card information.

    Other service providers may get access to Personal Information so they can help with:

    1. Delivering your orders;

    2. Managing your account and communicating with you, including sending you confirmations, updates, technical notices, security alerts and support and administrative messages;

    3. Fulfilling requests for the Services;

    4. Protecting against, investigating, and deterring fraudulent, harmful, unauthorized or illegal activity;

    5. Providing reports to you based on information collected from your use of the Services;

    6. Providing support and assistance in connection with your use of the Services;

    7. Enhancing your experience with our Websites;

    8. Complying with our contractual and legal obligations, resolving disputes with users and enforcing our agreements;

    9. Monitoring and analyzing trends, usage and activities in connection with the Websites; and

    10. Linking or combining Personal Information from our various sources of Personal Information (described above) to help us understand your needs and provide you with a better experience.

    We also share Personal Information with a limited number of other businesses that aren’t service providers. These businesses offer services to Feast, like serving advertisements on our behalf across the Internet, serving personalized ads on our Website, and providing analytics services. Unlike with our service providers, these businesses have not promised to use Personal Information that we provide solely in connection with the Services, and they may use your Personal Information for other purposes.

  6. SOCIAL FEATURES

    Certain features of the Services permit you to initiate interactions between the Services and third-party services or platforms, such as social networks (“Social Features”). Social Features include features that allow you to click and access the Company’s pages on certain third-party platforms, such as Facebook and Twitter, and from there to “like” or “share” our content on those platforms. Use of Social Features may entail a third party’s collection and/or use of your data. If you use Social Features or similar third-party services, information you post or otherwise make accessible may be publicly displayed by the third-party service you are using. Both the Company and the third party may have access to information about you and your use of both the Services and the third-party service.   7. THIRD PARTY WEBSITES AND LINKS

    Our Services may contain links to other online platforms operated by third parties. We do not control such other online platforms and are not responsible for their content, their privacy policies, or their use of your information. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms (such as Facebook or Twitter) may also be viewable by other users of the Services and/or users of those third-party online platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators except as disclosed on the Services. We expressly disclaim any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of personal information by third parties. Any information submitted by you directly to these third parties is subject to that third party’s privacy policy.

  8. Communications preferences

    We may send you communications (including emails, phone calls, text messages, push notifications, and snail mail) to your account regarding transactions initiated by you (such as order status updates and billing receipts), which we need to do in order to offer the Services to you.

    We may also send additional communications about the Services, such as newsletters and additional options that may be of interest to you by email and snail mail. We do our best to only send this type of communication to people who want to receive it. If you would like to discontinue receiving these communications, you can update your preferences by using the “Unsubscribe” link found in such emails or by contacting us using the information in Section 11.

    How long we retain your Personal Information depends on the type of data and the purpose for which we process the data. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

    We utilize a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Information from unauthorized access, use, or disclosure. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. Any information you send us through any means is transmitted at your own risk.
